1. ABOUT THIS POLICY

1.1 Foodographer Studios is committed to protecting your privacy and handling your personal information responsibly. This Privacy Policy explains what personal information we collect, how we use it, and your rights under the Privacy Act 2020.

1.2 This policy applies to all personal information collected through our website at foodographer.nz, our enquiry and onboarding forms, and in the course of providing our services.

1.3 By using our website or engaging our services, you agree to the collection and use of your information in accordance with this policy.

2. WHAT PERSONAL INFORMATION WE COLLECT

2.1 We may collect the following personal information:

(a) Contact details – name, email address, phone number, and business name, collected when you submit an enquiry or onboarding form;

(b) Business information – details about your brand, products, and content requirements, collected through our onboarding forms;

(c) Communications – emails, messages, and other correspondence you send to us;

(d) Payment information – bank account details for invoicing purposes. We do not store credit card information;

(e) Website usage data – information about how you use our website, collected through cookies and analytics tools including Google Analytics and Meta pixel; and

(f) Marketing preferences – whether you have opted in or out of marketing communications from us.

2.2 We collect personal information only by lawful means and only where it is necessary for the purposes set out in this policy.

2.3 We may also collect personal information about you indirectly – for example through cookies, analytics tools, and advertising pixels when you visit our website. Where we collect information indirectly, we will ensure you are informed about that collection through this Privacy Policy and our cookie consent banner, in accordance with the Privacy Act 2020 including IPP 3A.

3. HOW WE COLLECT PERSONAL INFORMATION

3.1 We collect personal information in the following ways:

(a) When you submit an enquiry or onboarding form on our website;

(b) When you contact us directly by email or other means;

(c) When you engage our services and enter into a Contract with us;

(d) Automatically through cookies and analytics tools when you use our website; and

(e) When you leave a review on our Google Business profile – note that reviews submitted via Google are governed by Google’s Privacy Policy, not this policy.

4. HOW WE USE YOUR PERSONAL INFORMATION

4.1 We use your personal information for the following purposes:

(a) To respond to your enquiries and discuss our services with you;

(b) To provide our photography and content services to you;

(c) To send invoices, process payments, and manage our business relationship with you;

(d) To plan and deliver your shoots, including pre-production planning and image delivery;

(e) To send you marketing communications about our services, where you have consented to receive them;

(f) To improve our website and understand how visitors use it; and

(g) To comply with our legal obligations.

4.2 We will not use your personal information for any purpose other than those set out above without your consent.

5. COOKIES AND TRACKING TECHNOLOGIES

5.1 Our website uses cookies and similar tracking technologies to analyse site traffic, understand user behaviour, and improve your experience on the site.

5.2 We currently use the following tools which may set cookies on your device:

(c) Other third party tools – we may from time to time use additional third party tools that set cookies. These will be disclosed in our cookie consent banner.

5.3 You can manage your cookie preferences at any time using the cookie settings on our website. You can also control cookies through your browser settings, however disabling certain cookies may affect your experience on the site.

5.4 Our website uses an opt-out consent model for non-essential cookies, consistent with the Privacy Act 2020. Essential cookies required for the site to function are always active.

6. SHARING YOUR PERSONAL INFORMATION

6.1 We do not sell your personal information to third parties.

6.2 We may share your personal information with:

(a) Third party service providers – such as email marketing platforms, accounting software, and cloud storage providers – where necessary to operate our business. These providers are contractually required to keep your information confidential and use it only for the purpose of providing services to us;

(b) Google and Meta – through the use of analytics and advertising tools as described in Section 5; and

(c) Legal and regulatory authorities – where required by law or where we reasonably believe disclosure is necessary to protect our rights or the rights of others.

6.3 Where we use third party service providers, your data may be processed on servers located outside New Zealand. Where this occurs, we take reasonable steps to ensure your information is protected to a standard comparable to the Privacy Act 2020.

7. EMAIL MARKETING

7.1 We may use your email address to send you marketing communications about our services, new packages, and relevant updates – but only where you have consented to receive them.

7.2 You can unsubscribe from marketing communications at any time by clicking the unsubscribe link in any email we send, or by contacting us at kiaora@foodographer.nz

7.3 Unsubscribing from marketing communications will not affect our ability to send you transactional communications related to your engagement with us – such as invoices, pre-production plans, and image delivery notifications.

8. DATA STORAGE AND SECURITY

8.1 Your personal information is stored on servers located in New Zealand.

8.2 We take reasonable steps to protect your personal information from loss, unauthorised access, disclosure, or misuse, including appropriate technical and organisational security measures.

8.3 No method of data transmission or storage is completely secure. While we take all reasonable precautions, we cannot guarantee the absolute security of your information.

9. HOW LONG WE KEEP YOUR INFORMATION

9.1 We retain your personal information for as long as necessary to provide our services and fulfil the purposes set out in this policy, including for legal and accounting requirements.

9.2 Client image libraries are retained for the duration of the client engagement plus 6 months, after which images are archived. See our Client Terms and Conditions for full details.

9.3 Where you have enquired about our services but have not engaged us, we will retain your contact details for a reasonable period for follow-up purposes, after which they will be deleted or anonymised.

10. YOUR RIGHTS

10.1 Under the Privacy Act 2020 you have the right to:

(a) Request access to the personal information we hold about you;

(b) Request correction of any personal information that is inaccurate, out of date, incomplete, or misleading;

(c) Withdraw consent to marketing communications at any time; and

(d) Make a complaint to the Office of the Privacy Commissioner if you believe we have breached your privacy rights.

10.2 To exercise any of these rights, contact us at kiaora@foodographer.nz. We will respond within a reasonable timeframe and in accordance with our obligations under the Privacy Act 2020.

11. DATA BREACH NOTIFICATION

11.1 If Foodographer Studios becomes aware of a privacy breach that is likely to cause serious harm to any individual, we will notify the affected individual(s) and the Office of the Privacy Commissioner as soon as practicable, in accordance with our obligations under the Privacy Act 2020.

11.2 We maintain internal procedures for identifying, assessing, and responding to privacy breaches.

12. COMPLAINTS

12.1 If you have a concern about how we have handled your personal information, please contact us in the first instance at kiaora@foodographer.nz and we will work to resolve the matter promptly.

12.2 If you are not satisfied with our response, you may lodge a complaint with the Office of the Privacy Commissioner at privacy.org.nz.
